What is Florida traffic court?
Answer: Every county has traffic court; some of the bigger counties have it more so than some of the rural counties. Traffic court has a judge, has a prosecutor who is the police officer—Florida is interesting in the fact that cops prosecute their own cases; we don’t have a municipal or state prosecutor. So what ends up happening in traffic court is, if you hire an attorney, the attorney goes in and tries to beat the citation if possible. If we can’t beat the citation, then we attempt to get a withhold of adjudication, which under Florida law is no points and wouldn’t cause or have this issue of suspension as a result of points. So, the results that we get happen in court, and that’s traffic court in Florida.
