What types of expert witnesses may be called to testify regarding science in a Florida DUI case?
Answer: It’s going to depend on what the scientific issue is in the case. So, I deal with experts based on the area that I see there being a problem—if it’s the actual analytical testing, it might be one type of expert. If it’s the breath test machine and the analytical testing of that, it’s going to be a different expert. If it’s a preservation of a sample, it’s going to be a different type of expert. If it’s the toxicology or pharmacology, it’s going to be a different type of expert. So we’re going to be, we would use, obviously, an expert for the specific scientific issue that we are wanting to present in court.
