So the officer has to prove the case because there’s no state prosecutor in Florida; the officer has to prove violation beyond a reasonable doubt. And I’ll tell you in accident cases, for example, the officer must rely on third parties—either the other driver if he gets subpoenaed by the clerk, or an independent witness—in order to prove the case for the officer, because Florida has something called an accident report privilege and anything you tell the officer at the scene of an accident is privileged and can’t be used against you.
