Under these state statutes, if you knowingly sell, purchase, manufacture, deliver, or bring into the state or are in actual or constructive possession of seven grams or more of oxycodone, or any mixture containing oxycodone, you will be charged with Trafficking in Oxycodone. Your penalties will depend on the amount of the drug in your possession:
Punishment for Trafficking Oxycodone
- If the amount of Oxycodone you sell, purchase, manufacture, deliver, bring into the state or are in actual or constructive possession of at least 7 grams of Oxycodone, but less than 14 grams of the drug, and you are convicted of the offense, you will face a mandatory minimum prison term of three years, and a fine of $50,000.
- If the amount of Oxycodone you sell, purchase, manufacture, deliver, bring into the state or are in actual or constructive possession of at least 14 grams of Oxycodone, but less than 25 grams of the drug, and you are convicted of the offense, you will face a mandatory minimum prison term of seven years, and a fine of $100,000.
- If the amount of Oxycodone you sell, purchase, manufacture, deliver, bring into the state or are in actual or constructive possession of at least 25 grams of Oxycodone, but less than 100 grams of the drug, and you are convicted of the offense, you will face a mandatory minimum prison term of fifteen years, and a fine of $500,000.
- If the amount of Oxycodone you sell, purchase, manufacture, deliver, bring into the state, or are in actual or constructive possession of at least 100 grams of Oxycodone, but less than 30 kilograms of the drug, and you are convicted of the offense, you will face a mandatory minimum prison term of twenty-five years, and a fine of $750,000.
- If you knowingly sell, purchase, manufacture, deliver, bring into the state, or are in actual or constructive possession of 30 kilograms or more of Oxycodone, you will be punished by life in prison without any form of discretionary early release other than a pardon, executive clemency, or a conditional medical release.
- If, in addition to Trafficking in Oxycodone, you kill an individual, cause an individual to be killed, or your conduct led to a natural—though not inevitable—lethal result, you have committed a capital felony, and could receive life in prison without parole or the death penalty.
- If you knowingly bring 60 kilograms or more of Oxycodone into the state of Florida, you have committed a capital felony, and could face life in prison without parole as well as the maximum fine allowed.
